In Canada last week, I witnessed a justice system that operated swiftly, fairly, and with professionalism. This experience instilled hope for crime victims within our own country. The Ontario Court of Justice in Toronto conducted trials efficiently without the need for juries. Expert judges presided over cases and issued sentences ranging up to two years for less severe offenses and longer for more serious crimes, eliminating the time-consuming process of jury selection.

Comparatively, the UK’s justice system is facing a crisis due to a significant backlog of cases. The number of pending cases in England and Wales’ Crown Courts has escalated from around 38,000 in 2019 to nearly 80,000 currently, with projections estimating a rise to 116,000 by 2029. This backlog negatively impacts individuals seeking justice, particularly survivors of crimes like rape, violence, and burglary, who are left in limbo for years while awaiting trial.

While jury trials will continue to handle the most severe offenses like rape, murder, and bodily harm, there is a need for evolution in the justice system. The introduction of a new ‘Swift Court’ within the Crown Court will enable judges to address cases with anticipated sentences of three years or less, helping to expedite the legal process and reduce delays.

Addressing the challenges faced by the UK’s justice system requires more than just financial investment. The focus should also be on optimizing court resources by ensuring the availability of judges, prosecutors, defense lawyers, and court staff. With the evolution of technology and forensic advancements, the complexity of cases has increased, leading to longer trial durations.

Efforts are being made to enhance the efficiency of courts and streamline the legal process. However, there is a pressing need for comprehensive reforms to revitalize a justice system that has been neglected. Failing to act will result in further suffering for victims as the system deteriorates. By looking to examples like Canada, where modernization has improved court processes, the UK government aims to implement bold reforms for a more effective justice system.
