ABC has taken legal action against the Federal Communications Commission (FCC), alleging that the agency’s request for early review of broadcast licenses poses a significant threat to its operations. The lawsuit, filed by ABC and its parent company Disney, along with eight local stations affected by the early renewal proceedings, seeks to halt the FCC’s actions.

The FCC, led by chairman Brendan Carr, a supporter of President Donald Trump, initiated the early review of ABC’s licenses in April. This move was considered unusual and was linked to the network’s diversity practices. However, it followed a controversial joke made by ABC’s late-night host Jimmy Kimmel, known for his criticism of President Trump.

ABC’s lawsuit claims that the administration’s actions against the network’s speech have escalated to the point of threatening its broadcast licenses. The network argues that it has been left with no choice but to seek judicial intervention to address the retaliation for its First Amendment rights.

The ongoing conflict between ABC and the FCC includes disputes over the treatment of the morning talk show “The View” under equal-time rules. ABC argues that the FCC’s actions against the network extend beyond individual grievances and could set a dangerous precedent for media freedom across the country.

The lawsuit also received support from FCC Democrat Anna Gomez, who praised ABC and Disney for standing up against what she described as censorship and control by the FCC. Meanwhile, Chairman Carr defended the FCC’s actions, emphasizing broadcasters’ obligation to operate in the public interest and restore trust in the news media.

The FCC reiterated its stance on broadcasters’ responsibilities, including the obligation for Disney and all broadcasters to operate in the public interest. The commission highlighted ongoing examinations of diversity and inclusion practices within Disney and affirmed its commitment to uphold legal standards in the matter.
